Terms and conditions

These terms govern use of the eWheelGo website, application, electric vehicles, and rental services. A booking or continued use of a vehicle confirms your agreement to these terms and the rental agreement shared at handover.

1. Definitions

“eWheelGo”, “we”, “our”, or “First Party” means eWheelGo Mobility Pvt. Ltd. and its authorised employees, agents, and service partners. “User”, “customer”, “you”, or “Second Party” means the person receiving or using a vehicle or service.

“Vehicle” means an electric scooter or bike supplied for rental. “Services” includes vehicle rental, delivery, verification, maintenance, roadside help, support, payment processing, and related digital services. Ownership of every vehicle remains with eWheelGo.

2. Agreement and scope

This agreement records the responsibilities of eWheelGo as the service provider and the customer as the service user. Obligations begin when a booking or rental agreement is confirmed. You must provide accurate documents and information requested for verification and delivery.

3. Rental duration

Daily rentals are measured by the confirmed rental period. Weekly and monthly rentals begin at the time recorded during handover. Late return, unauthorised extension, or continued possession may result in an additional rental charge.

4. Vehicle delivery and mechanical issues

Delivery depends on service-area coverage, accurate address and contact information, vehicle availability, and delivery-team capacity. Customers should reconfirm time and location before a scheduled handover.

Vehicles are checked before handover. If a mechanical problem occurs, contact customer support immediately. We may arrange inspection, repair, roadside help, or a replacement where reasonably available. Damage caused by an accident, neglect, or misuse may be charged separately.

5. User registration

Customers must be at least 18 years old, provide accurate registration details, hold a valid government identity document and driving licence for the relevant vehicle class, and use an accepted payment method. Foreign licences may require additional validation.

You must promptly tell us if your licence is suspended, withdrawn, expired, or restricted. We may refuse or suspend registration where documents are inaccurate, verification fails, or safety and policy requirements are not met.

6. Vehicle leasing process

To rent a vehicle, you must complete registration, pass verification, select an available vehicle and plan, accept the displayed price and rental agreement, and carry your valid driving licence while riding. A request becomes a confirmed booking only after eWheelGo sends confirmation.

7. Payments and deposits

You must pay all rental fees, deposits, delivery or collection charges, taxes, penalties, repair assessments, and other confirmed amounts when due. Final charges may vary by plan, city, vehicle, rental duration, and services selected.

Refundable deposits are returned after the vehicle is checked and outstanding dues or valid deductions are cleared. Processing timelines will be stated in the confirmed rental agreement.

8. Device location and vehicle monitoring

Vehicles may contain location and diagnostic devices used to protect assets, detect misuse or theft, investigate incidents, support customers, and analyse vehicle performance. Related information is handled under our Privacy Policy.

9. Right of withdrawal

You may request cancellation of registration or marketing communication by contacting customer support. Cancellation and refund rights for a confirmed rental depend on whether service has started and the cancellation terms shared during booking.

10. Fee policy

Failure to pay a rental fee or other amount on time may result in a late charge, suspension, recovery action, or termination. Applicable fees and penalties will be communicated through the booking or rental agreement.

11. General terms of use

Customers must complete the vehicle orientation, wear a helmet and suitable footwear, carry a valid driving licence, follow Indian traffic rules, reduce speed on damaged roads and speed breakers, respect load limits, and immediately report faults, accidents, theft, or damage.

The vehicle may not be transferred to an unauthorised customer, used under the influence of alcohol or drugs, used for unlawful activity, overloaded, modified, dismantled, or taken outside an approved service area without written permission.

12. Termination

You may end the service through customer support, subject to returning the vehicle and clearing all dues. eWheelGo may suspend or terminate service for non-payment, false documents, unsafe use, unlawful use, licence problems, unauthorised customers, damage, theft risk, repeated policy breaches, or failure to report an accident.

14. Intellectual property

eWheelGo owns or licenses its names, marks, software, designs, content, operating material, and vehicle-related intellectual property. No ownership is transferred to a customer, and no part may be copied, licensed, sold, or commercially used without written permission.

15. Modification, amendment, and severability

Material rental-specific changes must be agreed through the applicable booking or rental record. If any provision is found invalid or unenforceable, the remaining provisions continue in effect.

16. Waiver and injunctive relief

A delay in enforcing a right does not waive that right. Any waiver must be in writing. eWheelGo may seek urgent legal relief where misuse of vehicles, confidential information, intellectual property, or other serious breach may cause irreparable harm.

17. Indemnification

To the extent permitted by law, a customer is responsible for losses, claims, penalties, and reasonable legal expenses arising from unlawful use, breach of these terms, false information, negligence, or damage caused by the customer or an unauthorised user.

18. Non-disparagement

Nothing prevents honest reviews, lawful complaints, or reports to authorities. Neither party should knowingly publish false or malicious statements intended to damage the other party or its personnel.

19. Liability and disclaimer

To the extent permitted by law, eWheelGo is not liable for indirect, consequential, special, or punitive loss. Customers remain responsible for their conduct, traffic violations, and damage caused while operating a vehicle. Nothing excludes liability that cannot legally be excluded.

20. Non-solicitation

During a commercial engagement and for a reasonable period afterward, business customers may not knowingly solicit dedicated eWheelGo employees or service partners involved in that engagement without prior written consent.

21. Force majeure

Neither party is responsible for delay caused by events beyond reasonable control, including natural disasters, war, civil disruption, epidemic, major infrastructure failure, or government restriction. The affected party should notify the other and take reasonable steps to reduce impact.

22. Miscellaneous

The parties remain independent. These terms, the Privacy Policy, the confirmed booking, and the signed rental agreement form the entire agreement for the service. Electronic acceptance and counterparts may be treated as valid records.

23. Dispute resolution

Disputes should first be addressed through good-faith discussion. If unresolved, they may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat and venue in Hyderabad, Telangana, and proceedings in English.

24. Governing law and jurisdiction

These terms are governed by Indian law. Subject to applicable consumer rights and arbitration provisions, courts in Hyderabad, Telangana, have jurisdiction. Questions may be sent to legal@ewheelgo.in.
